1. Acceptance of Terms

By accessing or using Dhanvantari AI Lab Private Limited (the "Platform"), you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Nature of Services

Dhanvantari AI Lab Private Limited provides AI-assisted tools and educational content to help users better understand health concerns. The Platform may analyze user-provided information (e.g., symptoms, vitals, lifestyle inputs) to generate insights and educational materials.

3. NO MEDICAL ADVICE (NON-DIAGNOSTIC CLAUSE)

THE PLATFORM IS A PERSONAL HEALTH RECORD (PHR) TOOL AND DOES NOT PROVIDE CLINICAL DIAGNOSES, MEDICAL ADVICE, OR TREATMENT. Always seek the advice of a qualified healthcare professional for medical concerns.

Emergency Use Disclaimer: The Platform is not intended for medical emergencies. If you are experiencing a medical emergency or life-threatening symptoms, immediately call your local emergency services (e.g., 102/108) or visit the nearest hospital. Do not rely on the Platform or AI for emergency assistance.

AI Disclaimer: Any AI-generated summaries, insights, or educational content provided by the Platform's AI Companion may contain errors, inaccuracies, or "hallucinations." All AI-generated content must be independently verified by a licensed physician before taking any health-related actions.

Doctor-Patient Relationship: Using the "AI Companion" or any informational features of the Platform does not create a doctor-patient relationship. A formal doctor-patient relationship is only established once you have successfully booked and commenced a consultation with a Registered Medical Practitioner (RMP) through the Platform.

RMP Accountability: While Dhanvantari AI Lab Private Limited facilitates the booking of consultations, the individual Registered Medical Practitioner (RMP) is solely responsible for the medical advice, diagnosis, and treatment provided during the consultation. Dhanvantari AI Lab Private Limited acts only as a technology platform and assumes no liability for the medical advice rendered by the RMP.

4. Eligibility and Account

You must be at least 18 years old (or the age of majority in your jurisdiction). You are responsible for safeguarding your account credentials and for all activities that occur under your account.

5. User Responsibilities

Provide accurate and truthful information. Do not misuse the Platform, including attempting to interfere with operation or security, reverse engineer, or use it for unlawful purposes.

6. Privacy and Consent Management

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and share information. Please review it carefully.

Consent Management: The Platform provides comprehensive consent management features that allow you to actively control and manage the permission of sharing your personal health data and medical records with Registered Medical Practitioners (RMPs).

Withdrawal of Core Consents: Please note that certain data points (such as your basic identity and age) are strictly necessary for the core functioning of Dhanvantari AI Lab Private Limited. If you choose to withdraw consent for these essential data points, Dhanvantari AI Lab Private Limited will be unable to provide you with its services, and your account may be subject to termination or deletion in accordance with our retention policies.

7. Plans, payments & billing

Three separate payment types: (1) Subscriptions and (2) wallet credits — sold through Apple In-App Purchase or Google Play Billing only; (3) doctor consultation fees — paid at booking through Razorpay (or another gateway), not through subscription, wallet credits, or app-store in-app products.

7.1 Free tier — Zivo Wellness

Zivo Wellness is available at no charge. You can create an account and use the free tier without a subscription. Free-tier features are described in the app at the time of use.

7.2 Subscriptions (Zivo Insights, Zivo 360)

Optional paid membership plans may be offered as auto-renewable subscriptions through Apple In-App Purchase (iOS) or Google Play Billing (Android). By subscribing, you agree to the plan name, price, billing period, and benefits shown at purchase.

7.3 Wallet credits (In-App Purchase consumables)

Optional wallet credits are prepaid balances for metered in-app digital features (for example AI usage). On iOS, wallet top-ups are sold only through Apple In-App Purchase (consumables), not through Razorpay or external web checkout. On Android, wallet top-ups use Google Play Billing where enabled.

7.4 Doctor consultation fees (not subscription or wallet)

Booking a live one-on-one video consultation may require payment of the doctor’s fee displayed at checkout when you schedule the appointment. That fee is set by the doctor or service offering, not by your subscription tier or wallet balance.

We may change plan features, wallet tiers, consultation availability, or pricing. Changes apply to new purchases and renewals as permitted by the app store, payment provider, or applicable law. Material changes to these Terms will be communicated as described in Section 16.

8. Intellectual Property

The Platform and its content are owned by or licensed to Dhanvantari AI Lab Private Limited and protected by applicable laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes.

9. User Content and Feedback

You retain ownership of content you submit. You grant Dhanvantari AI Lab Private Limited a worldwide, non-exclusive, royalty-free license to use your content to operate and improve the Platform, in accordance with the Privacy Policy. Feedback may be used without restriction or compensation.

10. Third-Party Services

The Platform may link to or integrate third-party services. We are not responsible for third-party content, terms, or policies.

11. Acceptable Use

You agree not to interfere with the Platform, test vulnerabilities, upload malicious code, or engage in fraudulent, deceptive, or unlawful activities, or violate third-party rights.

12. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13. Limitation of Liability

To the maximum extent permitted by law, Dhanvantari AI Lab Private Limited and its affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, or use. Our aggregate liability shall not exceed the greater of (a) the amount you paid (if any) for accessing the Platform in the 12 months preceding the claim, or (b) USD $100.

14. Indemnification

You agree to indemnify and hold harmless Dhanvantari AI Lab Private Limited and its affiliates from claims arising out of your use of the Platform or violation of these Terms.

15. Suspension and Termination

We may suspend or terminate access if you violate these Terms or for any lawful reason. Certain provisions survive termination.

16. Changes

We may modify the Platform and these Terms at any time. Material changes will be communicated (e.g., in-app). Continued use after changes constitutes acceptance.

17. Governing Law and Venue

These Terms are governed by the laws of India. Disputes shall be resolved exclusively in the courts located in Bengaluru, Karnataka, India.
